The Regional Administrative Court (TAR) of Aosta has ruled that sending chocolates and other gifts does not constitute harassment, upholding a man's appeal against a warning issued by the Police commissioner. The case involved a divorced father who, having fallen in love with his daughters' dance teacher, tried to win her over with gifts such as chocolates, flowers, perfume, and gallant messages. Despite his efforts, the woman never responded and blocked him on social media. She later requested a protective measure from the Police, triggering a warning from the Police commissioner, who deemed the man's behavior capable of generating fear in the victim. The man, however, appealed, also supported by his ex-wife, who called it unfair to treat him as a stalker for doing a romantic act. The TAR upheld the appeal, finding that the man's behaviors never resulted in harassment and that the gifts and messages were respectful and not pushy. The judge's decision led to the revocation of the Police commissioner's warning, considering that there had been no stalking or acts of intimidation.
