The President of the Republic, Sergio Mattarella, has promulgated the law known as "Ponte Morandi", which introduces benefits for victims of events caused by the total or partial collapse of road or highway infrastructure of national importance. However, the Head of State accompanied the signing with a letter addressed to the presidents of the Houses of Parliament and the Prime Minister, in which he expressed some constitutional reservations. According to Mattarella, the rule risks introducing discrimination, excluding victims of accidents of different kinds from benefits and, above all, penalizing children of couples who are not married or not civilly united. In the text, in fact, Article 2 provides compensation “to children, in the absence of the surviving spouse,” but does not specify whether children born of de facto unions or non-formalized relationships are also included. The President therefore calls for a broad interpretation of the provision, ensuring access to benefits for all children of victims, without discrimination. And he asks Parliament and the government to “carefully evaluate” the reported critical aspects and to consider possible supplementary and corrective measures to make the law fully compliant with constitutional principles”.
